Asian courts validate battery separator patents of Asahi Kasei.

The Japanese technology company Asahi Kasei has been successful in winning various litigation disputes relating to patents for separator films as a component of lithium-ion batteries.

The Japanese technology company Asahi Kasei has been successful in winning various litigation disputes relating to patents for separator films as a component of lithium-ion batteries.

Since mid-2018, the company has successfully defended its position against patent infringement by ‘Xu Ran Electronic and Others’ in China and Korea. In the case of an invalidation trial against a Chinese patent, the respective court in Beijing now rendered a judgment maintaining Asahi Kasei’s patent on September 28, 2021.

Already in December 2020, the Supreme People’s Court of the People’s Republic of China rendered a final decision which fully accepted Asahi Kasei’s claim of patent infringement and ordered to stop selling the above products and to pay compensation for damages.

Two years earlier, in August 2018, Asahi Kasei filed a patent infringement lawsuit with Shenzhen Intermediate People’s Court against, ‘Xu Ran Electronic and Others’, both selling separators for lithium ion secondary batteries in Shenzhen, China, as joint defendants, based on the Patent owned by Asahi Kasei, seeking an injunction prohibiting Xu Ran Electronic and Others from selling their “single-layer W-scope” battery separators in China and compensation for damages, a total of 1 million yuan, this is equivalent to a total of approx.140.000 Euro.

Also in Korea, the corresponding court ‘Intellectual Property Trial and Appeal Board’ (IPTAB) based in Daejon, issued a decision to dismiss the invalidation petition of the ‘W-Scope Cooperation’ and confirmed the validation of Asahi Kasei’s Korean patent on a separator for lithium-ion secondary batteries on December 2, 2020.

In March of the same year the ‘W-Scope Cooperation’ filed an invalidation petition of Asahi Kasei’s patent.

Asahi Kasei will pay close attention to issues concerning intellectual property rights, and if deemed necessary, take specific measures proactively against any infringement.
